Roodefontein Development Application:
Investigation Proceeds

After thorough perusal of the documentation submitted to me by the Premier of the Western Cape and others regarding the Roodefontein Development application, and having noted various reports in the media, I have appointed a Chief Investigator from my national office to deal with those aspects of the investigation which fall within the Public Protector�s mandate.
In terms of Section 6 (4) (c) of the Public Protector Act, which stipulates that if the Public Protector deems it necessary or advisable, he/she may refer any matter which has a bearing on an investigation, to the appropriate public body or authority, I have exercised my discretion and referred those aspects of the investigation which relate to possible criminal conduct, to the National Directorate of Public Prosecutions (NDPP) for further investigation.
I would like to indicate here that the complaint against the Premier of the Western Cape which was lodged by the Democratic Alliance is inextricably linked to the complaint against Mr Malatsi, and both complaints will be dealt with in the same manner.
Although this will not be a joint investigation, the office of the Public Protector and the NDPP will liaise closely as the investigation progresses and any emerging facts which indicate procedural misconduct and maladministration will be dealt with by my office with a view to making the necessary recommendations.
